Terms of Use

These terms cover the Jocundo games and the jocundo.com website. Jocundo is a one-person studio operated by me, Ishan Karunaratne, from New Jersey, United States. By downloading, installing, or playing one of my games, or by using this website, you agree to these terms. If you do not agree, please do not use the games or the site.

The short version

My games are free to play. I give you a personal license to play them, I keep the rights to the games themselves, and I ask you not to copy, resell, or tamper with them. They come as they are, without warranties, and my liability is limited as far as the law allows. Store purchases and refunds, if there ever are any, go through Apple or Google, not through me.

1. Who can use the games

My games are made for a general audience and are not directed at children under 13. If you are under the age of majority where you live, you may only use the games with the permission of a parent or guardian who agrees to these terms on your behalf. You must also comply with the terms of the app store you downloaded the game from (the Apple App Store or Google Play).

2. Your license

I grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play my games on devices that you own or control, for your own non-commercial entertainment. That is all the license covers. It does not transfer ownership of anything to you.

The games, including their code, characters, art, animation, audio, music, names, logos, and store listings, are owned by me and are protected by copyright, trademark, and other laws. "Jocundo" and the names of my games are my trademarks or trade names. Nothing in these terms gives you any right to use them, other than to refer to the games by name.

My games are original works. They are not affiliated with, sponsored by, or endorsed by any other game, studio, or publisher.

4. Free to play, ads, and purchases

My games are free to download and play. Some of them show advertising served by third parties (currently Google AdMob). How advertising handles data is described in my Privacy Policy. Advertisers and their content are not mine, and I am not responsible for what they offer.

If a game ever offers something for sale (for example an option to remove ads), the purchase is made through Apple or Google under their terms and payment systems. I do not receive or store your payment details. Refund requests are handled by the store you bought from, according to that store's refund policy.

5. Scores and sharing

Your best score is saved only on your own device. If you use a game's share feature to send a score card to a friend, that goes through the sharing tools of your own device and whichever service you choose. I do not run any leaderboards or accounts, and I do not receive what you share.

6. Updates and availability

I may update, change, or discontinue a game or any of its features at any time, with or without notice. Updates may be delivered automatically through the app store. I do not promise that any game will always be available, or that it will work on every device or operating system version.

7. The website

jocundo.com is an informational site about my games. You may browse it and link to it. You may not scrape it wholesale, use it to distribute malware, or copy its content and pass it off as your own. Where a page lets you play a game in the browser, the license in section 2 applies to that too.

8. Third-party services and links

The games and the site rely on services from other companies, such as Apple, Google, and advertising providers, and may link to sites I do not control. Those services and sites have their own terms and privacy policies, and I am not responsible for them.

9. No warranty

To the fullest extent permitted by law, my games and this website are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. I do not warrant that the games will be free of bugs, uninterrupted, or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, I will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the games or the website, even if I have been advised of the possibility of such damages. To the extent I am found liable for anything, my total liability to you will not exceed the greater of the amount you paid me for the game in the twelve months before the claim (which for a free game is zero) or ten US dollars. Some jurisdictions do not allow these limitations, so they may not apply to you.

11. Indemnity

You agree to hold me harmless from any claim, loss, or expense (including reasonable legal fees) that arises from your violation of these terms or your misuse of the games or the site.

12. Termination

Your license ends automatically if you break these terms. I may also end or suspend access to a game if I reasonably believe you are misusing it. When the license ends, you must stop using the game and delete your copies. Sections 3, 9, 10, 11, 13, and 14 survive termination.

13. Apple and Google

If you downloaded a game from the Apple App Store, these terms are between you and me, not Apple. Apple has no obligation to provide maintenance or support for the game and is not responsible for any claims relating to it, including product liability, legal compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Any warranty refund that Apple is required to give is limited to the purchase price, if any. If you downloaded a game from Google Play, Google's own terms of service and refund policy also apply to that download.

14. Governing law and disputes

These terms are governed by the laws of the State of New Jersey and the federal laws of the United States, without regard to conflict-of-law rules. Any dispute that cannot be settled informally will be brought in the state or federal courts located in New Jersey, and you consent to their jurisdiction. If you live somewhere whose consumer-protection laws give you rights that cannot be waived, those rights are unaffected. Before starting any formal dispute, please email me first; most problems can be sorted out with a conversation.

15. Changes to these terms

I may update these terms from time to time. When I do, I will post the new version here and change the date at the top. Continuing to use the games or the site after a change means you accept the updated terms. If a change is material, I will try to give reasonable notice, for example in an app update note.

16. General

These terms, together with the Privacy Policy and the Copyright / DMCA policy, are the whole agreement between you and me about the games and the site. If any part of these terms is found unenforceable, the rest still applies. If I do not enforce a term right away, that does not mean I have waived it. You may not assign these terms to anyone else; I may assign them to a successor of the studio.
