Copyright & DMCA Policy

I take other people's intellectual property seriously, and I would like mine to be respected too. This page explains how to report content on jocundo.com or in a Jocundo game that you believe infringes your copyright, how a counter-notice works, and how to reach me if you think someone is copying my games.
The short version
Send copyright complaints to hello@jocundo.com with the subject "DMCA notice" and the details listed below. I respond to complete notices promptly, in line with the Digital Millennium Copyright Act (17 U.S.C. § 512).
Reporting infringement (DMCA notice)
If you are a copyright owner, or authorized to act for one, and you believe that material on this site or in one of my games infringes your copyright, please send me a written notice that includes all of the following:
- Your physical or electronic signature.
- Identification of the copyrighted work you say has been infringed. If your notice covers several works, a representative list is fine.
- Identification of the material you say is infringing, with enough detail for me to find it: the URL on jocundo.com, or the game name and a description (or screenshot) of the specific asset or screen.
- Your contact details: name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Please note that under 17 U.S.C. § 512(f), anyone who knowingly makes a materially false claim that material is infringing may be liable for damages, including costs and legal fees. If you are not sure whether something infringes your rights, consider speaking with a lawyer before sending a notice.

Email is the fastest way to reach me. If you need a postal address for a formal notice, email me and I will provide one.
What I do when I receive a notice
When I receive a complete and valid notice, I will remove or disable access to the material identified, make a reasonable effort to notify whoever provided it (if it was not me), and keep a record of the notice. If a notice is incomplete, I will tell you what is missing so you can resubmit it.
Counter-notice
If material you provided was removed because of a notice and you believe the removal was a mistake or a misidentification, you may send me a counter-notice that includes:
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before it was removed.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, any judicial district in which I may be found), and that you will accept service of process from the person who filed the original notice or their agent.
If I receive a valid counter-notice, I will forward it to the person who sent the original notice. If they do not tell me within ten business days that they have filed a court action, I may restore the removed material.
Repeat infringers
My games have no user accounts and no user-generated content, so in practice there is little room for repeat infringement by users. Where it applies, I will terminate access for anyone who repeatedly infringes the copyrights of others.
Trademark and other complaints
This process is for copyright. If you believe a Jocundo game or page infringes your trademark, or raises another legal concern, please email hello@jocundo.com with the subject "Legal notice", a description of the mark or right, and where you believe it is being misused. I will look into it and reply.
Protecting my own work
The Jocundo games are original works: their names, characters, art, audio, and code are mine, and they are protected by copyright and trademark law. If you come across a clone, a repackaged copy of one of my games on another store, or a site distributing my games or assets without permission, I would be grateful if you let me know at hello@jocundo.com. I may update this page from time to time. The date at the top always shows the current version.
